TONY HANNEBERY

Tony completed his Bachelor of Laws Degree at Melbourne University and admitted to practise in 1970. He immediately took out a Practising Certificate and commenced working part time in his own practice and, in October 1973, began full time in his office in Douglas Parade Williamstown.

During his years in Williamstown, Tony became heavily involved with the Williamstown Football Club, initially as a player and eventually serving as club President before being appointed as Victorian Football Association (VFA) President.

Throughout his 50+ years in practice, Tony has appeared in all Magistrates, County and Supreme Courts and has succeeded in being appointed by the Law Institute of Victoria as an Accredited Criminal Law Specialist.

He regularly appears in the various Tribunals (VCAT, VOCAT and the Victorian Racing Tribunal, among other quasi criminal Tribunals) particularly in recent years with his ongoing representation of high-profile racing industry figures.

Tony is a highly skilled advocate who leads with kindness and compassion to reach the best possible outcome for his clients. He is a much loved and respected identity amongst the legal community and beyond.

MARCUS WILLIAMS

Marcus has been an Associate of Tony Hannebery at Tony Hannebery Lawyers for over 10 years , since coming over from Adelaide where he qualified as a Bachelor of Laws at Flinders University.

He has been involved in criminal law  defence work in all Magistrates , County and Supreme Courts throughout his career and has succeeded in being appointed by the Law Institute of Victoria as an Accredited Criminal Law Specialist.

He has also been involved in representing clients in the various Tribunals [ VCAT , VOCAT and the Victorian Racing Tribunal , among other quasi criminal Tribunals ].

Marcus is a true “people person “ with a terrific professional rapport with his client and also the Bench hearing the case . He prides himself on getting the best possible result for ALL his clients. He is not motivated by money but just his ambition to do his best by his clients and preserve his reputation as a legal professional who can be trusted absolutely by those with whom he deals.

He commands respect from the Police and fellow practitioners.

Marcus is a member of the VLA Indictable Crime Panel and has been for most of his legal career.

Age of Criminal Liability in Victoria: Overview

The age of criminal liability is the age at which a person can be arrested, charged, and found guilty of a criminal offense. In Victoria, the current age is 10, but there are planned changes to raise it to 12 in 2024 and to 14 by 2027.

Children Under 10:

Children under 10 cannot be arrested, charged, or found guilty of a criminal offense in Victoria.

Acts by children under 10 that would be offences if committed by older individuals may lead to consequences like parental discipline, teacher involvement, or referral to counselling.

Children Between 10 and 14:

For children aged 10 to 14, the prosecution must establish that they understood the act was a crime and that the behavior was wrong.

The doli incapax rule, meaning incapable of evil, is a rebuttable presumption that a child under 14 is not criminally responsible.

Children Over 14:

For young people aged over 14 but under 18, charges are dealt with in the Children’s Court.

The Children’s Court follows similar procedures and rules of evidence as adult cases, but additional rules may apply, such as requiring the presence of a responsible adult.

Sentencing for Young Offenders:

Sentencing of young offenders in Victoria falls under the Children, Youth and Families Act 2005.

The primary goal of sentencing is the rehabilitation of the young person.

Sentencing options include good behavior bonds, fines, youth supervision orders, periods of detention, and participation in diversionary programs.
